American Merchandising Specialists Employee Represented by Nichols Kaster Files Overtime Case

SAN FRANCISCO, CA--(Marketwire - May 12, 2010) -  On May 10, 2010 a former employee of American Merchandising Specialists, Inc. filed suit in the Eastern District of California, seeking payment under the Fair Labor Standards Act for unpaid overtime wages. The case is filed on behalf of all merchandisers in the United States who have worked for American Merchandising Specialists in the last three years. 

The complaint also alleges violations of California's overtime law, as well as violations of a California statute requiring reimbursement of business expenses. The complaint further alleges that affected employees did not receive meal and rest periods required by California law. The complaint seeks penalties under California law.

Plaintiffs' counsel Matthew Helland stated, "We believe that American Merchandising Specialists has been violating the law by not paying its merchandisers for all overtime hours worked, and by not reimbursing expenses. We hope to recover the money that is owed to these employees."

Plaintiffs are represented by Matthew Helland, James Kaster, and Matthew Morgan from Nichols Kaster, PLLP, which has offices in Minneapolis, Minnesota and San Francisco, California. The case is entitled Stout et al v. American Merchandising Specialists, Inc., Civ. No. 2:10-at-00617 (E.D.Cal.)
